Alternative Disputes Resolution

The primary goals of this course are to introduce students to the principal nonbinding dispute resolution processes and to help prepare students to use such processes to advance the interests of clients. In this essence the module is referring to everything from facilitated settlement negotiations in which disputants are encouraged to negotiate directly with each other prior to some other legal process, to mediation, arbitration systems, expert determination, or early neutral evaluation. The course then proceeds with an in-depth exploration of mediation in a particular way as far as the international enforcement of mediation settlement agreements under the Singapore Mediation Convention and the On-line Dispute Resolution process is concerned.
